Landlord Responsibilities in California: Your Legal Obligations in 2026
Owning rental property in California comes with a long list of legal responsibilities. The state’s tenant-friendly legal framework means landlords are held to high standards on everything from habitability to communication. Failing to meet these obligations can result in code violations, lawsuits, blocked evictions, and financial penalties.
This guide covers the core responsibilities every California landlord must meet in 2026, with specific attention to requirements in Los Angeles.
Maintaining Habitable Premises
California Civil Code requires landlords to maintain rental units in a habitable condition. This means ensuring the property has effective waterproofing and weather protection, functioning plumbing with hot and cold running water, working heating, electrical lighting and wiring in good condition, clean and sanitary common areas, adequate trash receptacles, floors, stairways, and railings in good repair, and working locks on doors and windows.
As of 2026, the habitability standard has expanded to include working stoves and refrigerators in every rental unit (AB 628). Microwave ovens and hot plates do not satisfy this requirement. Landlords who fail to provide these appliances face code enforcement citations and potential fines.
Disclosure Requirements
California landlords must provide numerous disclosures to tenants, either before or at the time of lease signing. These include lead-based paint disclosure for units built before 1978, mold disclosure, bed bug history, proximity to a former military ordnance location, registered sex offender database notice (Megan’s Law), and flooding and natural hazard zone information. In 2026, enhanced disclosure rules require clearer breakdowns of allowable fees versus rent, and documentation standards have been raised across the board.
Rent Increase Procedures
Whether your property is under the RSO or the statewide TPA, rent increases must follow specific rules. You must calculate the increase correctly based on the applicable cap, provide proper written notice (30 days for increases under 10%, 90 days for increases of 10% or more), and comply with any local filing requirements. For RSO properties in the City of LA, the current cap is 3% through June 2026, dropping to a formula based on 90% of CPI starting July 1, 2026.
Maintenance and Repair Response
When a tenant reports a maintenance issue, you have an obligation to address it promptly. California law doesn’t specify exact response times for routine maintenance, but habitability issues must be addressed within a reasonable timeframe—typically 30 days, and much faster for emergencies like no heat or water. Failure to make repairs can lead to rent withholding, repair-and-deduct remedies by the tenant, or code enforcement action.
Anti-Harassment and Retaliation Protections
The City of LA’s Tenant Anti-Harassment Ordinance prohibits landlords from harassing tenants through actions like removing housing services, withholding repairs, refusing to accept rent payments, or entering the unit without proper notice. California law also prohibits retaliatory actions against tenants who exercise their legal rights, such as requesting repairs, complaining to housing authorities, or organizing with other tenants.
Post-Disaster Obligations
Under SB 610, effective in 2026, landlords are now responsible for removing debris and mitigating hazards following natural disasters. This includes mold, smoke, smoke residue, ash, asbestos, and water damage. Given LA’s wildfire exposure, this is a significant new obligation that requires planning and potentially additional insurance coverage.
